Under and by virtue of the power of sale contained with that certain Security Deed dated November 12, 2025, from Benjamin Fouts to Mortgage Electronic Registration Systems, Inc., as nominee for American Pacific Mortgage Corporation, its successors and assigns, recorded on November 19, 2025 in Deed Book 01085 at Page 0195 Hart County, Georgia records, having been last sold, assigned, transferred and conveyed to American Pacific Mortgage Corporation by Assignment and said Security Deed having been given to secure a note dated November 12, 2025, in the amount of $196,377.00, and said Note being in default, the undersigned will sell at public outcry during the legal hours of sale before the door of the courthouse of Hart County, Georgia, on November 3, 2026 the following described real property (hereinafter referred to as the “Property”):
ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING IN THE 1117TH DISTRICT GM, HART COUNTY, GEORGIA AND BEING LOT 6, OF B.F. HILL SUBDIVISION AS SHOWN AND DELINEATED BY PLAT PREPARED BY TYSON AND ASSOCIATES, INC., LAVONIA, GEORGIA THROUGH CLELLAND A. TYSON, GRLS DATED DECEMBER 1, 1970, RECORDED IN PLAT BOOK 20, PAGE 629, HART COUNTY, GEORGIA RECORDS. SAID PLAT BEING INCORPORATED HEREIN BY REFERENCE THERETO.
SAID PROPERTY IS FURTHER IDENTIFIED AS TAX PARCEL NO. C27B 001, AND AS 142 WATER OAK DELL DR. LAVONIA, GA 30553.
The debt secured by the Security Deed and evidenced by the Note has been, and is hereby, declared due and payable because of, among other possible events of default, failure to make the payments as required by the terms of the Note. The debt remaining is in default and this sale will be made for the purposes of paying the Security Deed, accrued interest, and all expenses of the sale, including attorneys' fees. Notice of intention to collect attorneys' fees has been given as provided by law. To the best of the undersigned's knowledge, the person(s) in possession of the property is/are Benjamin Fouts.
The property, being commonly known as 142 Water Oak Dell Dr, Lavonia, GA, 30553 in Hart County, will be sold as the property of Benjamin Fouts, subject to any outstanding ad valorem taxes (including taxes which are a lien and not yet due and payable), any matters affecting title to the property which would be disclosed by accurate survey and inspection thereof, and all assessments, liens, encumbrances,restrictions, covenants, and matters of record to the Security Deed.

RELEASE OF FUNDS
On or about October 19, 2026, the Downtown Development Authority (DDA) of Hartwell will submit a request to the Georgia Department of Community Affairs for the release of Appalachian Regional Commission (ARC) funds under 24 CFR Part 58, Section 58.35(a) to undertake a project known as the Hart County Community Theatre Improvements project for to perform ADA accessibility, emergency egress, and other much needed improvements to the historic theater building's interior spaces that will create a venue for historical, educational, and cultural entertainment in downtown Hartwell.
The activities proposed comprise a project for which a Finding of No Significant Impact on the environment was published on October 1, 2026. An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at the City of Hartwell City Hall, 456 E. Howell Street, Hartwell, GA 30643 and at the Georgia Mountains Regional Commission, 1310 W. Ridge Road, Gainesville, GA 30531, and may be examined or copied weekdays 8:30 A.M. to 4:30 P.M.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to Paul Sewell, DDA of Hartwell Chairman. All comments received by October 16, 2026 will be considered by the DDA of Hartwell prior to authorizing submission of a request for release of funds.
ENVIRONMENTAL
CERTIFICATION
The DDA of Hartwell certifies to the Georgia Department of Community Affairs (GDCA) that Paul Sewell in his capacity as Chairman consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. GDCA's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the DDA of Hartwell to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
GDCA will accept objections to its release of funds and the DDA of Hartwell's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: a) the certification was not executed by the Certifying Officer of the DDA of Hartwell; (b) the DDA of Hartwell has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs, or undertake activities not authorized by 24 CFR Part 58 before approval of a release of funds by GDCA; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Georgia Department of Community Affairs, Attn: Appalachian Regional Commission, 60 Executive Park South, NE, Atlanta, GA 30329. Potential objectors should contact GDCA to verify the actual last day of the objection period.
